There are 4 basic legal steps you need to take to sell your property lawfully.

  1. Prepare a contract of sale (in ACT & NSW you’ll need to do this before you list your property). Get the buyer to sign it. It’s now a legally binding document. 
  2. Meet any special conditions outlined in your contract until settlement day.
  3. Allow the buyer to inspect your home 2-3 days pre-settlement to make sure it’s still in the same condition as they signed the contract of sale.  
  4. Meet the seller or their representative to sign and hand over all documents and monies.
