Regarding what you need to do as a landlord in SA and how to protect yourself:
Before Approving a Tenant
1. Ensure you have had a check done on the tenant (which you can arrange through us).
2. Ensure you have phoned/ checked all the tenant’s references (they will be asked to supply current employer, current landlord, and personal references on our tenancy application)
Once you wish to approve a Tenant
You will need to meet with the tenant, sign an agreement with them, provide them with some printed factsheets, and also complete a report on the condition of the property. Links and further explanation below.
1. Meet with them and sign a Residential tenancy agreement form, which is available here: https://www.sa.gov.au/topics/housing/renting-and-letting/renting-privately/forms-and-fact-sheets-for-private-rental-tenancies and supply a copy to the tenant (within 21 days of signing)
2. Supply the tenant with the information brochure which sets out the rights and responsibilities of landlord and tenant: https://www.sa.gov.au/__data/assets/pdf_file/0012/12072/Information_brochure.pdf (at the time of signing the lease)
3. Supply the tenant with the water charging fact sheet which explains what water costs landlords and tenants are legally responsible for: https://www.sa.gov.au/__data/assets/pdf_file/0003/11964/Charging_for_water_bulletin.pdf (at the time of signing the lease)
4. Supply the tenant with the repairs and maintenance fact sheet which explains who is responsible for repairs and maintenance: https://www.sa.gov.au/__data/assets/pdf_file/0010/13024/Repair_and_maintenance_of_rented_properties.pdf (at the time of signing the lease)
5. Complete an inspection sheet, keep one copy for yourself and supply two copies to the tenant. Where possibly, it can be helpful to complete this together with the tenant to minimize disagreements about what is noted. 6. Request a bond of 4 weeks rent from the tenant. When you receive it, make sure to provide the tenant with a receipt, and then lodge the money with Residential Bonds Online service of to the Consumer and Business Services as soon as possible. During the Tenancy
Conduct routine inspections of the property no more than once a month (up to 4 times a year recommended). Make sure to provide the tenant notice using this form: no less than 7 and no more than 14 days
before the day of entry
2. Make sure to keep documentation of any occurrences, e.g. copies of any letters/receipts you send to tenant, photos of any damage etc. just in case there ever a dispute in future,
We strongly recommend completing National Tenancy Database / TICA blacklist checks before approving any tenant (you can arrange this through PropertyNow). In addition to checking tenancy blacklists, you should also consider checking the ACCR criminal court attendance database here: https://auccr.com/free and may order full police background checks through PropertyNow if you wish
